Legal Objective

Its object is trade intermediation, advertising services, public relations, and similar, as well as electronic exploitation on behalf of third parties. These activities may be carried out by the company either directly or indirectly, including through the ownership of shares or interests in other companies with an identical or similar object.

1. Users

Access to and/or use of the Fontanet Group website (hereinafter THE COMPANY) attributes the condition of user to whoever performs it, accepting, from that very moment, fully and without any reservation, these general conditions, as well as the particular conditions that, where appropriate, complement, modify, or replace the general conditions in relation to certain services and contents of the website.

2. Use of the website, its services, and contents

The user agrees to use the website and its services and contents without contravening current legislation, good faith, generally accepted uses, and public order. Likewise, it is prohibited to use the website for illegal or harmful purposes against Fontanet Group or any third party, or in any way that could cause damage or impede the normal functioning of the website. Regarding the contents (information, texts, graphics, sound and/or image files, photographs, designs, etc.), the following is prohibited:

• Their reproduction, distribution, or modification, unless authorized by their legitimate owners or legally permitted.
• Any violation of the rights of Fontanet Group or its legitimate owners over them.
• Their use for any type of commercial or advertising purposes, other than those strictly permitted.
• Any attempt to obtain the contents of the website by any means other than those made available to users as well as those commonly used in the network, provided they do not cause any harm to the Fontanet Group website.

3. Unilateral modification

Fontanet Group may modify unilaterally and without prior notice, whenever it deems appropriate, the structure and design of the website, as well as modify or delete services, contents, and the conditions of access and/or use of the website.

4. Hyperlinks

Those websites that establish hyperlinks with the pages of this Fontanet Group website must refrain from reproducing said pages. Frame links, deep links, image links, or any others that may violate the company's proprietary rights, such as unfair competition, illegal advertising, intellectual and industrial property rights, image rights, honor, and commercial reputation or similar, are expressly prohibited.

Likewise, they must refrain from using distinctive signs, trade names, signs, information, or any other content proper to the website, except for the indication that forms part of the link itself and provided that this is legally and/or contractually covered, for example under our brand policy, especially in cases of confusion or association.

The above extends to its use as meta tags, keywords, or similar, including its specific use in search engines. In no case may it be implied or stated that the company has authorized, intervenes, assumes, participates, or has supervised in any way the contents of the page in which the hyperlink, meta tag, keyword, or similar appears, nor even that it consents to the inclusion of these, except with express authorization.

5. Exclusion of Warranties and Liability

Fontanet Group does not grant any warranty nor is it responsible, in any case, for damages of any nature that may be caused by:

• The lack of availability, maintenance, and effective operation of the website and/or its services or contents.
• The lack of utility, adequacy, or validity of the website and/or its services or contents to satisfy specific needs, activities, or results or user expectations.
• The existence of viruses, malicious, or harmful programs in the contents.
• The reception, obtaining, storage, dissemination, or transmission of the contents by users.
• The illegal, negligent, fraudulent use, contrary to these general conditions, to good faith, to generally accepted uses, or to public order, of the website, its services, or contents by users.
• The lack of legality, quality, reliability, utility, and availability of services provided by third parties and made available to users on the website.
• The breach by third parties of their obligations or commitments in relation to the services provided to users through the website.

6. Duration

The duration of the provision of the website service and services is of an indefinite nature. Notwithstanding the foregoing, the right is reserved to interrupt, suspend, or terminate the provision of the website service or any of the services that integrate it, under the same terms set forth in the third condition.

7. Intellectual Property

For the purposes of preserving possible intellectual property rights, in the event that any user or a third party considers that a violation of their legitimate rights has occurred due to the introduction of certain content on the web, they must notify Fontanet Group of said circumstance, indicating:

• Personal data of the interested party who is the owner of the allegedly infringed rights. If the claim is filed by a third party other than the interested party, they must indicate the representation with which they act.
• Indication of the contents protected by intellectual property rights and their location on the web.
• Proof of the aforementioned intellectual property rights.
• Express declaration in which the interested party is responsible for the veracity of the information provided in the notification. Both the trademark and the corresponding graphic marks are registered trademarks, and their reproduction or use without the authorization of their owner is prohibited. The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is the exclusive responsibility of the same. Privacy policy: these conditions relating to privacy policy are part of these general conditions.

8. Applicable Law and Jurisdiction

These general conditions shall be governed by Spanish law, and the user, expressly waiving any other jurisdiction that may correspond to them, submits to the jurisdiction of the courts and tribunals of the user's domicile for any issues that may arise or actions exercised derived from the provision of the web service and its services and contents regarding the interpretation, application, compliance, or non-compliance with what is established herein. In the event that the user has their domicile outside of Spain, the user, expressly waiving any other jurisdiction that may correspond to them, submits to the jurisdiction of the courts and tribunals of Barcelona.
